1. Agreement and Scope
These Terms of Service govern access to christmastraditions.shop and purchases made through the store. By using the website or placing an order, you agree to these Terms, our Privacy Policy, Return and Refund Policy and Shipping and Delivery Policy. Mandatory German and EU consumer rights remain unaffected. If you do not agree, do not use the store.
2. Eligibility and Account Responsibility
You must have legal capacity to enter the relevant transaction or act with the required consent of a legal representative. You are responsible for accurate account information, safeguarding credentials and activity conducted through your account. Notify us promptly of suspected unauthorised access. We may restrict access where reasonably necessary for security, fraud prevention or legal compliance.
3. Product Information
We aim to describe products accurately, including material, dimensions, colour, included components and intended use. Images are illustrative and screen settings may affect colour. Minor variations may occur in handmade-style, natural-material or batch-produced decorations. Product packaging may differ from images without changing essential characteristics. If an error materially affects an order, we will provide an appropriate remedy under applicable law.
4. Prices and Taxes
Prices displayed to German consumers are intended to include applicable VAT where required, unless clearly stated otherwise in a legally permissible context. The final price is shown before order submission. Standard delivery is free. Obvious pricing or technical errors may be corrected, but we will not charge a corrected higher amount without your agreement. Discounts cannot be combined unless expressly stated.
5. Order Process and Contract Formation
Product presentation is an invitation to place an order, not necessarily a binding offer. You submit an order by completing checkout and activating the final button that clearly indicates an obligation to pay. An automated acknowledgement confirms receipt but does not necessarily constitute acceptance. A contract is formed when we expressly accept the order or dispatch the goods, depending on the wording communicated during checkout. We may decline an order for legitimate reasons such as unavailability, payment failure, suspected fraud, delivery restrictions or an obvious error.
6. Payment
Available payment methods are shown at checkout and processed by the relevant provider. You authorise the charge and confirm that you are permitted to use the selected method. Orders may be held while payment or fraud checks are completed. We do not impose undisclosed payment fees. Chargebacks should not be used to avoid contacting us about a resolvable service issue, but this does not limit lawful payment-dispute rights.
7. Delivery
Free standard delivery applies to all orders. The estimated delivery time is 15–20 calendar days after dispatch unless a different estimate is displayed or communicated. Delivery dates are estimates unless expressly agreed as binding. Risk generally passes to a consumer when the consumer or a designated third party other than the carrier takes physical possession, subject to applicable law. 8. Cancellation, Withdrawal and Returns
Consumers may have a statutory 14-day right of withdrawal and may also qualify for our voluntary 30-day return policy. Exceptions can apply, including certain personalised or sealed hygiene-sensitive goods. Procedures, return costs and refunds are described in the Return and Refund Policy. Statutory remedies for defective or non-conforming goods are not restricted by a voluntary return policy.
9. Product Use and Safety
Follow all labels, warnings, installation instructions and age guidance. Decorative items are not toys unless expressly stated. Keep small parts, fragile items, cords, batteries and unsuitable materials away from children and pets. Do not use indoor-only electrical items outdoors. Do not place flammable decorations near flames, heaters or hot surfaces. Users are responsible for ordinary safe use, but these Terms do not exclude liability that cannot lawfully be excluded.
10. Intellectual Property
Website text, graphics, logos, photographs, layout, software and other content are protected by intellectual property laws and may belong to us, Shopify, suppliers or licensors. You may use the site for personal shopping and may not reproduce, scrape, republish, sell, reverse engineer or exploit content without permission, except where law permits.
11. Reviews and User Content
If you submit a review, photograph or other content, you confirm that you have the right to do so and that it is accurate, lawful and does not infringe another person’s rights. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for operating and promoting the store, subject to applicable data protection law. We may moderate or remove unlawful, irrelevant, fraudulent or abusive content.
12. Prohibited Conduct
Using the site for unlawful, fraudulent or abusive activity.
Introducing malware, interfering with security, probing vulnerabilities or overwhelming the service.
Impersonating another person, submitting false payment or delivery details, or attempting unauthorised access.
Automated extraction or commercial reuse of content without permission, except as law permits.
Violating intellectual property, privacy or other rights of any person.
13. Availability and Changes
We may maintain, update or modify the website and may discontinue products. We do not guarantee uninterrupted access, but we will not use changes to deprive consumers of rights under an existing contract. Material changes to Terms apply prospectively unless law permits otherwise and appropriate notice is provided.
14. Liability
Nothing in these Terms excludes or limits liability for intent, gross negligence, injury to life, body or health, product liability, guarantees, mandatory statutory rights or any liability that cannot lawfully be excluded. For slight negligence involving an essential contractual obligation, liability may be limited to foreseeable damage typical for the contract to the extent permitted by law. No broader exclusion applies where it would be invalid under German law.
15. Force Majeure
We are not responsible for delay caused by events outside reasonable control, such as severe weather, carrier disruption, strikes, customs intervention, infrastructure failure, epidemic restrictions or governmental action. We will take reasonable steps to reduce the impact and inform affected customers. Mandatory rights concerning late or failed performance remain unaffected.
16. Governing Law and Disputes
German law applies to the extent permitted, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another EU country, this choice does not deprive you of mandatory protection under the law of that country. Statutory jurisdiction rules apply. 17. Severability and Contact
